Revoking indefinite leave to remain in the UK: caseworker guidance   18 October 2023

The Immigration staff guidance on revoking indefinite leave has been updated to reflect the changes to the EU Exit Citizens’ Rights Appeals Regulations 2020. This describes the revocation of indefinite leave to enter or remain in accordance with section 76 of the Nationality, Immigration and Asylum Act of 2002.

As mentioned on page Page 5 of 30 of the guidance: indefinite leave can be revoked under section 76 of the 2002 Act when a person:

  • is liable to deportation but cannot be deported for legal reasons
  • ceases to be a refugee, or is the dependant of someone who ceases to be a refugee, in specified circumstances
  • has obtained indefinite leave by deception
